These Terms of Use ("Terms") govern your use of the Elvean website, located at https://elvean.app ("Website"), and the Elvean macOS application ("App"). By accessing the Website or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our Website or using Elvean services, you agree to comply with these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately. Continued use after any updates to these Terms constitutes acceptance of the revised Terms.

2. Terminology

"You" and "your" refer to the person accessing the Website or using the App. "We," "us," and "our" refer to Elvean. "Parties" refers to both you and Elvean collectively.

3. Use of the App

Elvean is a native macOS application that connects to AI services configured by you. You are responsible for:

  • Providing your own API keys for third-party AI services
  • Complying with the terms of service of any AI providers you connect to
  • Any content you generate or actions you take using the App
  • Keeping your API keys and credentials secure

4. Subscriptions

Elvean offers auto-renewable subscription plans ("Elvean Pro") available via in-app purchase through the Apple App Store.

  • Billing: Payment is charged to your Apple ID account at the time of purchase confirmation.
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Plans: Monthly and Annual plans are available. Prices may vary by region and are subject to change. Current pricing is displayed in the App Store and within the App at the time of purchase.
  • Free Trials: If offered, any unused portion of a free trial is forfeited upon purchasing a subscription.
  • Management: You can manage or cancel your subscription at any time through your Apple ID settings (Settings → Apple ID → Subscriptions).
  • Refunds: Refund requests are handled by Apple in accordance with their refund policy.

5. Intellectual Property

Elvean and its licensors own all intellectual property rights for the Website content, App design, branding, and associated materials. You may not republish, sell, rent, sub-license, reproduce, or redistribute any Elvean content without prior written permission.

6. User Content

All conversations, prompts, and data you create within the Elvean app are stored locally on your device and remain yours. Elvean does not claim any ownership over content you generate.

7. Cookies

Our Website may use cookies to enhance your experience and analyze site activity. By accessing the Website, you consent to cookie usage in accordance with our Privacy Policy.

8. Third-Party Services

Elvean integrates with third-party AI services (including but not limited to Ollama, Claude, OpenAI, Gemini, Grok, Groq, and OpenRouter). We are not responsible for the availability, accuracy, or content of responses from these services. Your use of third-party services is subject to their respective terms and policies.

9. Hyperlinking

Organizations may link to our Website provided the link is not deceptive, does not falsely imply sponsorship, and fits within the context of the linking party's site. We reserve the right to request removal of any links at our discretion.

10. Disclaimer of Warranties

Elvean is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App or Website will be uninterrupted, error-free, or free of harmful components. AI-generated content may be inaccurate — you are responsible for verifying any output.

11. Limitation of Liability

To the maximum extent permitted by law, Elvean and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or App. This includes, without limitation, damages for loss of data, revenue, or profits.

12. Reservation of Rights

We reserve the right to amend these Terms at any time. We also reserve the right to request removal of any links to our Website that we deem inappropriate.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, and any disputes shall be subject to the exclusive jurisdiction of the relevant courts.
